1. The agreement
Food Score ("the app") is published by Froggy Eye Ltd, a company registered in the United Kingdom ("we", "us", "our"). These Terms of Use, together with our Privacy Policy, form the agreement between you and us for your use of the app.
If you do not agree to these terms, do not install or use Food Score. If you already have, uninstall it.
2. Your licence to use Food Score
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Food Score on devices you own or control, for your own non-commercial use, in accordance with these terms and with the rules of the app store you obtained it from.
You must be old enough to form a binding contract where you live. You may not sublicense, resell, rent, reverse-engineer, decompile or modify the app, or attempt to extract its source code, except to the extent that applicable law expressly permits it.
3. Scores are information, not medical advice
Food Score is an informational and educational tool. It is not a medical device, and nothing in it is medical, dietary, or nutritional advice.
A health score is a number our own algorithm calculates from a product's published nutrition values. It is a general guide to how a food compares on those values — not an assessment of whether that food is right for you, your body, your condition, your medication or your goals. The "healthier alternatives" the app suggests are automatically generated ideas, not a meal plan.
Do not use Food Score to diagnose, treat, or manage any medical condition, and do not change your diet, treatment or medication on the strength of what it tells you. If you are pregnant, have a medical condition such as diabetes, kidney disease, coeliac disease, high blood pressure or an eating disorder, or are following a diet prescribed to you, talk to a doctor, pharmacist or registered dietitian. If you think you are having a medical emergency, contact your local emergency service.
The health goals you select in the app only change how information is presented to you. Selecting a goal is not a clinical assessment and does not make any suggestion suitable for your condition.
4. Where the data comes from, and its limits
Food Score builds its results from sources we do not control:
- Open Food Facts, a public, community-maintained product database, supplies barcode lookups and the nutrition values that come with them. Entries are contributed by volunteers and may be incomplete, out of date, mismatched to the product in your hand, or simply wrong.
- AI food recognition identifies food from a photo and estimates its nutrition. It is a statistical guess. It can misidentify a food entirely, and its nutrition figures are approximations, not measurements.
Manufacturers also reformulate products and change pack sizes without changing the barcode. The label on the packaging is always the authoritative source — check it rather than relying on what the app shows. Scores, calorie counts, daily totals and alternatives are provided for general information and are not guaranteed to be accurate, complete or current.
5. Allergies and intolerances
Never rely on Food Score to decide whether a food is safe for an allergy or intolerance.
The app does not perform allergen screening, and the data it draws on may omit ingredients, allergen warnings and "may contain" statements entirely. Always read the physical packaging and, where it matters, check with the manufacturer.
6. Acceptable use
You agree not to:
- Use the app for any unlawful purpose
- Photograph people, documents or anything other than food for AI recognition, or submit content you do not have the right to submit
- Submit content that is illegal, abusive or infringing, or attempt to make the AI produce such content
- Interfere with, overload, scrape or attempt to circumvent the app or the third-party services it relies on, including by automated or excessive querying
- Attempt to bypass, tamper with or falsify the in-app purchase and entitlement checks, or the display of ads
- Present the app's output to other people as professional nutritional or medical advice
7. Your content and photos
Your scan history, meals, daily totals and health goals are yours. They are stored on your device and we do not host them, so we claim no licence or ownership over them.
Photos you submit for AI recognition are sent to our server function and forwarded to OpenAI purely to produce a result for you, as described in the Privacy Policy. We do not store them, and we do not use them for anything else. You grant us only the limited permission needed to process a photo for that purpose, and you confirm you have the right to submit it.
Because your data lives only on your device, keeping it safe is your responsibility. Deleting the app, losing the device, or resetting it will remove that data permanently, and we cannot recover it for you.
8. Advertising in the free version
The free version of Food Score is supported by banner and interstitial ads served by Google AdMob. We do not choose, endorse or vet the individual ads you see, and we are not responsible for advertisers, their products, or the sites their ads lead to. Holding a Premium subscription removes ads.
9. Premium, subscriptions and auto-renewal
Food Score is free to download and includes a free tier with limits. Food Score Premium removes ads and unlocks the premium features, and is offered as:
- Monthly subscription — renews every month until cancelled
- Annual subscription — renews every year until cancelled
All purchases are processed by the Apple App Store or Google Play, not by us. Prices are shown in the app in your local currency before you buy, and are the prices held by the store at that moment.
Auto-renewing subscription terms. Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
Subscriptions renew automatically for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
You can manage your subscription and turn off auto-renew in your account settings after purchase: on iOS, Settings › [your name] › Subscriptions; on Android, Google Play Store › Payments & subscriptions › Subscriptions. Deleting the app does not cancel a subscription.
Where a free trial is offered, it is granted by the store and only if your store account is eligible. Cancel at least 24 hours before the trial ends to avoid being charged. Any unused portion of a free period is forfeited when you buy a subscription.
Premium is tied to the store account that bought it, and can be restored on your other devices using that account via "Restore Purchases". Prices may change; where a change affects a subscription you already hold, the store will notify you and, where required, ask for your consent before the new price applies.
10. Cancelling and refunds
You can cancel a subscription at any time through your store account, as described above. Cancelling stops future renewals; Premium remains active until the end of the period you have already paid for, and part-periods are not refunded except where the law requires it.
Refunds are issued by Apple or Google under their own policies, not by us — we have no ability to refund a store purchase. Contact Apple Support or Google Play Support. If you are a UK or EU consumer, your statutory cancellation and refund rights are unaffected by anything in these terms.
11. Intellectual property and third-party data
Food Score, its name, logo, design, scoring algorithm and software are owned by Froggy Eye Ltd and protected by intellectual property law. These terms grant you a licence to use the app, not any ownership of it.
Product data and images come from Open Food Facts and remain subject to its licences — the database under the Open Database License (ODbL) and individual product images under their own terms. Brand names, logos and packaging shown in results belong to their respective owners; Food Score is not affiliated with, endorsed by, or sponsored by any food manufacturer or brand it displays.
12. Availability and changes to the app
We may add, change, suspend or remove features, and we may stop supporting older operating system versions or devices. Features that depend on third-party services — the product database, the AI provider, the ad network, the stores — may degrade or stop working if those services change, rate-limit, or become unavailable. That is outside our control.
If we discontinue a paid feature you currently hold a subscription to, we will handle it fairly and in line with consumer law.
13. Disclaimers
Except for the warranties that cannot be excluded under the law of your country, Food Score is provided "as is" and "as available", without warranties of any kind. We do not warrant that the app will be uninterrupted or error-free, that a product will be found, that a photo will be identified correctly, or that any score, nutrition value, ingredient list or suggestion will be accurate, complete, current or suitable for your circumstances.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data, arising from your use of Food Score. Where we are liable, our total liability to you is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or £50.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, you keep all your statutory rights, including under the Consumer Rights Act 2015.
Subject to that, we are not responsible for dietary or health decisions you make using the app, or for the consequences of eating or avoiding a food because of what it showed you.
15. Termination
You may end this agreement at any time by uninstalling the app. We may suspend or end your licence if you materially breach these terms — for example by tampering with purchase verification or using the app unlawfully. Sections that by their nature should survive (intellectual property, disclaimers, liability, governing law) continue to apply after termination.
16. App Store and Google Play terms
Your use of the app is also subject to the terms of the store you downloaded it from. Where you obtained Food Score from the Apple App Store: this agreement is between you and Froggy Eye Ltd only, not Apple; Apple has no obligation to provide maintenance or support; Apple is not responsible for addressing any claim relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
17. Governing law
These terms are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK or in the EU, you keep the protection of the mandatory consumer laws of your country of residence and may bring proceedings in your local courts.
18. Changes to these terms
We may update these terms — for example when features or pricing change. The current version always lives at this address, with the effective date at the top. Continuing to use the app after an update means you accept the revised terms; if you do not, stop using the app and cancel any subscription.
